What landlords need to know? 

The landlord must use the Michigan court system and the court reqirments in order to evict a tenant. A landlord in Michigan can evict a tenant if:

1.  A tenant fails to pay rent.Note: You must serve a tenat a notice to quit

2.  A tenant’s use of the property causes a serious continuing health hazard

3. A tenant’s use of the property causes an extensive and continuing physical injury to the property, involves illegal activities or violates the terms of the rental agreement.

4. A tenant does not move out after the lease is terminated.
 
5. Violation of lease agreement. 







Important Notice:  Before a landlord can evict the tenant, he/she must first give the tenant a Notice of Termination that tells the tenant what the problem is.  For some termination notices, the landlord must wait a specific number of days to see if the tenant corrects the problem before they can file the complaint with court. The number of days the tenant has to correct the problem is set out in the notice.  If the tenant does not correct the problem and/or does not move out, the landlord can file an lawsuit in district court and a hearing will be scheduled.
